The Publication, made by an anonymous commenter, was taken down. However, according to the plaintiff, a man with great reputation, the system&#8217;s internal architecture enables comments including slander, and therefore, until blocked, it must be shut down.<\/p><\/blockquote>\n<p>1.<br \/>\nThis how a redundant article may appear in one of the Israeli News Sites in a year or so, after they do not go out against wrongfully decided court decisions such as OCR  3485\/08 <a href=\"http:\/\/www.2jk.org\/praxis\/wp-content\/uploads\/2008\/03\/httpshare.pdf\">NM v. Eli Amar<\/a>. The Decision, given two weeks ago and <a href=\"http:\/\/www.ynet.co.il\/articles\/0,7340,L-3514662,00.html\">published today on Ynet<\/a> determines that Israeli Internet Service Providers shall block access to a website enabling users to engage in file-sharing, since it, allegedly, provides likes to torrents. (See also, C 167\/07 <a href=\"http:\/\/www.courts.co.il\/SR\/mechozi\/m07000167-386.htm\">NMC v. Amar<\/a>)<\/p>\n<p>2.<br \/>\nThis is not the only decision with exists in the current era. <strong>New Sound Interactive<\/strong>, <a href=\"http:\/\/www.ice.co.il\/article.asp?catId=2&amp;pgId=117428\">requested that Israeli ISPs block access to PaNet<\/a>, a website which allegedly infringes its copyright. These requests came to Israel after a busy month in fighting world censorship. First of all, a Danish court <a href=\"http:\/\/www.techdirt.com\/articles\/20080204\/213143171.shtml\">ordered a Danish ISP  to block access<\/a> to the popular file-sharing site <a href=\"http:\/\/thepiratebay.org\/\">The Pirate Bay<\/a> (what only <a href=\"http:\/\/www.techdirt.com\/articles\/20080211\/031224223.shtml\">increased its traffic<\/a>); Later on, <a href=\"http:\/\/www.2jk.org\/praxis\/?p=1166\">access was blocked from<\/a> <a href=\"http:\/\/88.80.13.160\/\">WikiLeaks<\/a> when a <a href=\"http:\/\/www.dailykos.com\/storyonly\/2008\/2\/18\/91556\/1784\/766\/458936\">temporary injunction was given<\/a> against the domain registrar, which was only remove <a href=\"http:\/\/www.eff.org\/press\/archives\/2008\/02\/29\">following intervention from the EFF and ACLU<\/a>.<\/p>\n<p>3.<br \/>\nAnd what is so problematic with the Court&#8217;s decision? first of all, it has no legal grounds (the decision itself was given like in the Wikileaks case, with the Defendant&#8217;s consent). Not the <a href=\"http:\/\/he.wikisource.org\/wiki\/%D7%A4%D7%A7%D7%95%D7%93%D7%AA_%D7%96%D7%9B%D7%95%D7%AA_%D7%99%D7%95%D7%A6%D7%A8%D7%99%D7%9D\">Israeli Copyright Order<\/a> nor the civil torts act or the <a href=\"http:\/\/he.wikisource.org\/wiki\/%D7%97%D7%95%D7%A7_%D7%96%D7%9B%D7%95%D7%AA_%D7%99%D7%95%D7%A6%D7%A8%D7%99%D7%9D\">Copyright Act<\/a> acknowledge <strong>an Injunction blocking Users from accessing a website in this level<\/strong>, as the users are not a party to the process nor is the ISP a hosting provider. The ISP is simply granting access to a website which only provides links for users to use in file sharing programs. The Users themselves chose to infringe copyright. (<em>and until today no court decision was given claiming links to files stored elsewhere deem as liability for copyright infringement<\/em>).<\/p>\n<p>4.<br \/>\nThe real problem is the problem cause. If until now we faced chosen censorship which enables <em>voluntary censorship<\/em> (meaning that we may chose to prevent blocking), this blocking is involuntary and absolute. Copyright infringing sites are first, of course, as their plaintiffs have financial interests here.<\/p>\n<p>5.<br \/>\n[Unfortunately] <strong>there is no organisation claiming to block child pornography sites in the name of child protection<\/strong> nor is there any extreme Jewish group calling to block nazi websites. The real reason file sharing sites were first is the major financial gain from censoring it. Today it&#8217;s file sharing, tomorrow? all the internet ports of a file sharing websites.These are, unfortunately the great problems of the web<br \/>\n: <a href=\"http:\/\/room404.blogli.co.il\/archives\/246\">Child pornography, gambling and copyright infringement<\/a>. What do they have in common? we all know. <strong>The same people whose name would be hurt will seek injunctive relief later on, and slowly all the websites will be taken down<\/strong> Censorship may be obsolete, as there is no need for internet without free speech.<\/p>\n<p>6.<br \/>\n<strong>This is a fight for our freedom.
